Foreign Manufacturer’s Scheme abbreviated as FMCS is a scheme under BIS which is formed to ensure quality and safety of the public. Foreign manufacturers are granted FMCS license provided their product’s standards are in compliance with BIS standards.

Eligibility Criteria of BIS FMCS for Valves, Cylinders and Regulators

 

  • Foreign manufacturers must ensure that their factories where the production occurs must be located outside India.
  • Foreign Manufacturers must make sure to be in compliance with all the standards of BIS.
  • A manufacturer who sells valves,cylinders and regulators have to pay registration fee, audit fee, license fee, advance minimum marking fee, performance bank guarantee, etc. to the BIS FMCS authorities.
  • Valves, Cylinders and Regulators must be thoroughly tested before applying for an FMCS license.
  • Authorized Indian Representative(AIR) is to be nominated by the manufacturer to act on behalf of the firm in front of the FMCS authorities.

Process of BIS FMCS for Valves, Cylinders and Regulators

 

Preparation: Foreign Manufacturer has to ensure that all the terms and conditions as well as the required documents such as business license, copy of declaration of conformity, manufacturing process, details about machinery, any trademark proof etc.

Registration Form:Any manufacturer willing to apply for FMCS certification can apply online at the BIS portal or they can register their firm by providing the required documents at the FMCD department in Delhi. The manufacturer has to make sure to fill in complete and correct information in the application form.

Issue Raised (if any):If the authorities find any missing or incomplete information in the submitted application form, an email is sent to the organization informing them about the same. Authorities will consider an application for registration

Nomination of AIR:AIR is an Authorized Indian Representative. AIR is a person who is elected to act on the behalf of the manufacturer in front of the BIS authorities. A person who knows FMCS regulations, valves, cylinders, regulators, and government rules and regulations is eligible to become an AIR.

Factory Audit:BIS authorities visit the manufacturing unit on a mutually agreed upon date. The authorities visit the factory premises to understand the quality and safety standards being followed for production in-depth. They verify multiple factors such as manufacturing process, machinery, location, raw materials used for the production, testing facilities available at the site etc.

Product Sample:Product’s efficiency, safety and quality is also essential to understand along with the factors related to production. Therefore, the authorities collect the sample of the product and send it to the BIS accredited and NABL-certified laboratories to assess its performance.

Laboratory Results:Once, the reports of laboratory tests are received, it is analyzed to know the further action. If the reports suggest the compliance of standards-the action will be issuing the license whereas if the reports suggest non-compliance of standards -the action will be to stop the process for further changes.

Issuance of Certification:As mentioned earlier, the process of granting the license to the manufacturer will begin after positive laboratory reports are received. The manufacturer has to pay for the license fee, advance minimum marking fee and other miscellaneous fee to obtain the FMCS license.

Indemnity Bond and PBG:The manufacturer has to sign an indemnity bond with the BIS authorities. Along with that, the manufacturer has to pay USD 10,000 as Performance Bank Guarantee.

Validity of BIS FMCS for Valves, Cylinders and Regulators

 

Valves, cylinders and regulators are assessed thoroughly to avoid any mishappenings such as explosion or fire. Therefore, positive laboratory reports lead to grant of FMCS license. The initial certification of the FMCS license is provided for 2 years. After which, the manufacturer has to pay a renewal fee to renew the FMCS license. Successful payment of renewal of license leads to the issuance of renewed certificate. The renewed certificate is valid for a minimum of 1 year to a maximum of 5 years. If the certification is renewed after the expiry date of the initial certification, the manufacturer has to pay a late fee of Rs 5,000 to the BIS authorities as a compulsion.
